Landowner guide: Leasing land for energy in Poland
Understanding lease contracts and usufruct rights for Polish land.
Contract types
Energy projects usually use a long-term lease (dzierżawa) or a usufruct right (użytkowanie). Contracts typically last 25 to 30 years.
Rent and indexation
Landowners receive a rent per hectare or per megawatt installed. It is standard to include annual indexation to protect against inflation.
Tax implications
Leasing land for energy may change the tax status of the property from agricultural to industrial, which usually increases the property tax.
Restoration
Contracts must clearly state the developer's obligation to remove all equipment and restore the land at the end of the lease period.
