Italy energy project land lease and landowner negotiations

Understanding the legal forms and commercial terms for securing land in Italy.

Diritto di Superficie

The most common legal form for energy projects in Italy is the 'Diritto di Superficie' (surface right), which separates the ownership of the land from the ownership of the project.

Securing the site

Developers usually sign a 'pre-contratto' or 'opzione' while they wait for permits. Once the project is authorized, the final surface right deed is signed before a notary.

Commercial terms

Compensation is typically an annual fee based on the installed capacity (MW) or the land area (hectares). Terms usually last 30 to 40 years.

Key clauses

Negotiations often focus on access rights, insurance, and the landowner's right to continue farming or grazing on the parts of the land not occupied by the project.
