France land lease agreements for energy projects
Key considerations for developers and landowners when securing land for energy projects in France.
Securing the land
Developers typically start with a 'Promesse de bail' (lease promise), which gives them the right to secure the land once all permits are obtained.
Long-term leases
The final agreement is usually a 'Bail Emphytéotique' or 'Bail à Construction', which can last 20 to 40 years. These are registered at the land registry.
Landowner compensation
Lease payments are often calculated per hectare or as a percentage of the project's revenue. Additional payments may be made for site access and cable easements.
Site restoration
Lease agreements must include clear provisions for decommissioning the project and restoring the land to its original state at the end of the term.
